MOBILE MESSAGE SERVICE TERMS OF USE

By opting in to receive text messages from Relentless Rebel Apparel (“Relentless Rebel,” “we,” “us,” or “our”), you agree to these Mobile Message Service Terms of Use (“Mobile Terms”).

This Mobile Message Service is operated by Relentless Rebel LLC.

1. PROGRAM DESCRIPTION

If you elect to receive marketing or transactional text messages from us, either through our website, a checkout opt-in, a subscription form, or by sending a text message indicating your consent, you consent to receive recurring automated text messages (“Text Messages”) from Relentless Rebel Apparel.

Text Messages may include, but are not limited to:

  • Promotional offers

  • Product launches

  • Order confirmations and shipping updates

  • Cart abandonment reminders

  • Account notifications

Message frequency varies.

Participation in this program is optional and not a condition of any purchase.

2. CONSENT

By providing your mobile number and opting in, you provide your prior express written consent to receive Text Messages sent using an automatic telephone dialing system or similar technology.

You confirm that:

Message and data rates may apply according to your wireless carrier and individual rate plan.

Relentless Rebel Apparel and its affiliates are not responsible for any charges incurred by you from your wireless carrier.

5. CARRIERS AND DELIVERY

Wireless carriers are not liable for delayed or undelivered messages.

Delivery of Text Messages is subject to effective transmission from your network operator.

If your carrier does not support SMS messaging, you may not receive Text Messages.

6. SHORT CODES AND TELEPHONE NUMBERS

We may change the short code or telephone number used to operate the Mobile Message Service at any time and will notify you of any such changes.

You agree that messages sent to a number or short code that has been changed may not be received, and we are not responsible for honoring requests sent to outdated numbers.

7. PRIVACY

Information collected through the Mobile Message Service may include:

  • Your mobile phone number

  • Carrier name

  • Date, time, and content of messages

We use this information in accordance with our Privacy Policy and California Privacy Notice, including to operate the service and communicate with you.

8. ELIGIBILITY

You must be at least 18 years old to participate, or have permission from a parent or legal guardian.

9. DISCLAIMER AND LIMITATION OF LIABILITY

The Mobile Message Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law:

  • We make no warranties regarding the service

  • We are not liable for delayed, failed, or misdirected messages

  • We are not liable for any damages arising from your participation

Our total liability shall not exceed the amount you paid, if any, to participate in the Mobile Message Service.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Relentless Rebel Apparel and its affiliates from any claims arising out of:

  • Your use of the Mobile Message Service

  • Your violation of these Mobile Terms

  • Your provision of a mobile number that you do not own or control

11. DISPUTE RESOLUTION

Any disputes arising from or relating to the Mobile Message Service shall be governed by the Dispute Resolution and Arbitration provisions contained in our main Terms of Service, which are incorporated herein by reference.

12. GOVERNING LAW

These Mobile Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law principles.
